I have a signed lease (all parties signed) for a property we will be moving into in a few months. I’ve paid my share of the deposit, my other two roommates are still being waited on. There is nothing in the lease about how not paying the deposit will keep their spot. She (the landlord) is threatening to take their names off the lease and show the house to other students if they (my future roommates) do not pay her the deposit in a week.

I’m pretty sure now that the contract is signed by her, my roommates, and myself, that she has no legal right to do so. Would I be able to press charges or take legal action? If so, what are the damages that she will be responsible for? I’ve looked into the contract law for NJ and it says nothing about requiring a deposit, nor a deadline for it.
I’ve been telling her my housemates have financial issues (which they DO), and that they WILL be paying the deposit. They’re just not able to get it as soon as they’d like. We’re not playing games here, the money is coming from an honest place and my friends are having a hard time. It’s horrendous for someone like our landlord to be insensitive to such details when I’m sure she’s been in that kind of trouble herself.

BOTTOM LINE: We WILL pay the deposit, she’s putting a deadline on us that may not be matched, and I feel strongly that it’s illegitimate for her to cancel a contract that SHE SIGNED AND AGREED TO
